CHECKPOINT IS NOT A CURE OR TREATMENT FOR GAMBLING ADDICTION. This app can be bypassed, disabled, or defeated. Adversity Labs LLC is NOT LIABLE for money you lose gambling (whether the App blocks sites or not).

1. Acceptance of Terms

By downloading, installing, or using the Checkpoint mobile application, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App.

2. Description of Service

Checkpoint provides:

  • App and Website Blocking: Blocks access to selected gambling applications and websites
  • Session Management: Timed blocking sessions and scheduling features

3. CRITICAL DISCLAIMERS

3.1 Not a Medical Device

CHECKPOINT IS NOT A MEDICAL DEVICE, DIAGNOSTIC TOOL, OR TREATMENT FOR GAMBLING ADDICTION.

  • Checkpoint does not diagnose gambling disorders
  • Checkpoint does not treat compulsive gambling
  • Checkpoint is not a substitute for professional help

YOU ARE SOLELY RESPONSIBLE FOR YOUR GAMBLING BEHAVIOR.

4. AI Assistant - CRITICAL DISCLAIMERS

AI ASSISTANT EXPERIMENTAL FEATURE WARNING

THE "AI Companion" AI ASSISTANT IS EXPERIMENTAL, NOT VALIDATED, AND MAY PROVIDE HARMFUL, INCORRECT, OR DANGEROUS INFORMATION. DO NOT RELY ON THE AI COMPANION FOR MEDICAL, LEGAL, FINANCIAL, OR LIFE-CRITICAL DECISIONS.

4.1 AI Limitations and Disclaimers

THE AI COMPANION:

  • IS NOT A THERAPIST, COUNSELOR, OR MEDICAL PROFESSIONAL
  • May generate false, misleading, or completely fabricated information ("hallucinations")
  • Cannot diagnose or treat gambling addiction or any mental health condition
  • May provide advice that could worsen your situation if followed
  • Has no understanding of your specific medical, financial, or personal circumstances
  • May fail to recognize crisis situations or provide inappropriate responses
  • Could be manipulated to provide harmful content despite safeguards
  • May suddenly become unavailable or malfunction without warning

4.2 No Professional Relationship

INTERACTIONS WITH AI COMPANION DO NOT CREATE:
• A doctor-patient relationship
• A therapist-client relationship
• An attorney-client relationship
• A fiduciary relationship
• Any professional duty of care

AI COMPANION IS A SOFTWARE TOOL, NOT A PROFESSIONAL SERVICE PROVIDER.

4.3 Content Generated by AI

YOU ACKNOWLEDGE AND AGREE THAT:

  • All responses from the AI companion are generated by artificial intelligence algorithms
  • Content is NOT reviewed, verified, or endorsed by human professionals
  • Information may be outdated, incorrect, biased, or completely false
  • The AI companion may contradict itself or provide inconsistent advice
  • Any strategies or suggestions may be ineffective or counterproductive
  • Following the AI Companion's advice could lead to increased gambling, financial loss, or other harm

4.4 Prohibited Uses of AI Assistant

DO NOT USE THE AI COMPANION FOR:

  • Emergency or crisis situations (call 911 or crisis hotline instead)
  • Medical diagnosis or treatment decisions
  • Legal advice or representation
  • Financial planning or investment advice
  • As your primary or sole support for gambling addiction
  • To justify continued gambling behavior
  • As evidence in any legal proceeding
  • To make life-altering decisions

4.5 Data Collection and Privacy

WHEN YOU INTERACT WITH AI COMPANION:

  • Your conversations may be logged, stored, and analyzed
  • Data may be used to improve AI models (anonymized)
  • We may share conversation data with third-party AI providers
  • Conversations are NOT protected by therapist-patient privilege
  • Law enforcement may access conversations with valid legal process
  • DO NOT share sensitive personal, financial, or medical information

4.6 NO WARRANTY FOR AI SERVICES

THE AI ASSISTANT IS PROVIDED "AS IS" WITHOUT ANY WARRANTY. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• WARRANTY OF MERCHANTABILITY
• WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE
• WARRANTY OF ACCURACY OR RELIABILITY
• WARRANTY OF NON-INFRINGEMENT
• WARRANTY THAT THE SERVICE WILL BE ERROR-FREE

4.7 LIABILITY DISCLAIMER FOR AI INTERACTIONS

ADVERSITY LABS LLC IS NOT LIABLE FOR:

• Any harm resulting from following AI Companion's advice or suggestions
• Increased gambling or financial losses after using AI Companion
• Emotional distress or mental health deterioration
• Failure of AI Companion to recognize or respond to crisis situations
• Offensive, harmful, or triggering content generated by AI
• Misunderstandings or misinterpretations of AI responses
• Technical failures preventing access to AI Companion
• Any decisions you make based on the AI Companion's output

YOU USE AI COMPANION ENTIRELY AT YOUR OWN RISK.

4.8 User Responsibilities When Using AI

BY USING THE AI COMPANION, YOU AGREE TO:

  • Verify all information with qualified professionals before acting on it
  • Not rely solely on the AI Comapnion for gambling addiction support
  • Seek immediate professional help for crisis situations
  • Accept full responsibility for how you use information provided
  • Not attempt to manipulate AI companion to provide prohibited content
  • Report any concerning or dangerous responses to hello@checkpoint.so
  • Understand that AI Companion is an experimental feature that may be discontinued

4.9 Third-Party AI Services

The AI Companion may be powered by third-party AI services (such as OpenAI, Anthropic, Google, etc.). These providers:

  • Have their own terms of service and privacy policies
  • May process and store your conversation data
  • Are not under our control and may change without notice
  • May experience outages or discontinue service
  • We are not responsible for third-party AI provider actions or policies

4.10 Termination of AI Services

We reserve the right to:

  • Suspend or terminate the AI Companion access at any time without notice
  • Modify AI capabilities or responses without notification
  • Delete conversation history at our discretion
  • Implement usage limits or restrictions
  • Block users who misuse the AI assistant

5. User Responsibilities

5.1 Eligibility

You must:

  • Be at least 18 years old
  • Have legal capacity to enter into binding contracts
  • Comply with all local laws regarding gambling and app usage

5.2 Your Obligations

You agree to:

  • Provide accurate information during setup
  • Use the App in good faith to manage your gambling behavior
  • Not attempt to circumvent or defeat blocking mechanisms for malicious purposes
  • Seek professional help if you have a serious gambling addiction
  • Not rely solely on Checkpoint to prevent gambling
  • Understand that YOU are responsible for your actions, not the App

6. Subscription and Payments

IMPORTANT: Adversity Labs LLC does NOT process payments or handle refunds.

All payments are processed through Apple App Store (Apple Inc. is the merchant of record). All refunds are handled by Apple - we have no control over refund decisions.

7. LIMITATION OF LIABILITY

ADVERSITY LABS LLC AND CHECKPOINT SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE FOR:

Gambling-Related Losses

  • ANY AND ALL FINANCIAL LOSSES FROM GAMBLING - whether the App blocked sites or not
  • Money lost while the App was active, inactive, malfunctioning, or bypassed
  • Gambling debts incurred while using Checkpoint
  • Credit card charges, loans, or other financial obligations from gambling
  • Lost savings, retirement funds, or other assets due to gambling
  • Bankruptcy or financial hardship related to gambling

Maximum Damages

EVEN IF A COURT FINDS US LIABLE (WHICH WE DISPUTE), TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED: The amount you paid for Checkpoint subscriptions in the past 12 months, OR $1,000 USD (whichever is GREATER).

Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
• Use of Checkpoint is entirely at your own risk
• The App may fail to prevent gambling at any time
• YOU ARE SOLELY RESPONSIBLE for your gambling behavior and all consequences
• Adversity Labs LLC makes ZERO GUARANTEES about effectiveness
• Professional treatment is necessary for serious gambling addiction
• Checkpoint is NOT A REPLACEMENT for therapy, counseling, or support groups

8. Indemnification

You agree to indemnify, defend, and hold harmless Adversity Labs LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use or misuse of the App, your violation of these Terms, or your gambling activities or losses.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey and the United States of America, without regard to conflict of law principles.

10. ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

10.1 Agreement to Arbitrate

You and Adversity Labs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate (collectively, "Disputes"), will be settled by binding arbitration, except that either party may take claims to small claims court if they qualify for small claims court.

10.2 CLASS ACTION WAIVER

YOU AND ADVERSITY LABS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.Unless both you and Adversity Labs LLC agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

10.3 Arbitration Rules and Forum

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The AAA's rules and filing instructions are available at www.adr.org or by calling 1-800-778-7879.

  • The arbitration will be conducted by a single arbitrator
  • The arbitrator will be bound by these Terms
  • The arbitrator may award any relief available in court
  • The arbitration will be held remotely via video conference unless both parties agree to in-person proceedings
  • If you demonstrate that the costs of arbitration will be prohibitive compared to litigation costs, we will pay as much of the arbitration fees as the arbitrator deems necessary

10.4 Exceptions to Arbitration

Notwithstanding the above, either party may:

  • Bring an individual action in small claims court
  • Seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation or violation of intellectual property rights

10.5 Opt-Out Right

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to hello@checkpoint.so within 30 days of first accepting these Terms. Your notice must include your name, address, email address, and an unequivocal statement that you want to opt out of this arbitration agreement. If you opt out, all other parts of these Terms will continue to apply. Opting out has no effect on any previous arbitration agreements you may have had with us.

10.6 Severability of Arbitration Provision

If any portion of this arbitration agreement is found to be unenforceable, the unenforceable portion will be severed, and the remaining arbitration terms will be enforced (but in no case will there be a class or representative arbitration). If the class action waiver is found to be unenforceable, the entire arbitration agreement will be void.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Updating the "Last Updated" date at the top of these Terms

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App and may delete your account.

12. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent, or if that is not possible, it will be deleted.

13. Waiver

No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.

14. Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms and our rights hereunder at any time without notice or consent. Any attempted assignment in violation of this section will be null and void. These Terms will bind and inure to the benefit of each party's permitted successors and assigns.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Adversity Labs LLC regarding the App and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.

16. Force Majeure

We will not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
